Terms & Conditions

These Terms & Conditions ("Terms") govern your use of the WELL ERA website and your general relationship with WELL ERA INC. ("WELL ERA," "we," "us," or "our").

WELL ERA is a medical spa located in Dallas, Texas, offering non-medical cosmetic and aesthetic services as well as medical aesthetic services provided under applicable medical oversight.

By accessing our website, submitting information, booking an appointment, purchasing a service, treatment plan, package, program, membership, product, voucher, or other offering, or otherwise interacting with WELL ERA, you acknowledge and agree to these Terms together with any additional agreement or policy applicable to your transaction.

If you do not agree with these Terms, please do not use portions of our website or services that require acceptance of them.

Services are provided only by personnel who are appropriately trained, qualified, licensed, delegated, or supervised for the service being performed.

2. Medical Director and Clinical Oversight

WELL ERA maintains medical oversight for medical aesthetic services as required by applicable law.

Medical aesthetic services may be evaluated, ordered, authorized, delegated, performed, or supervised by appropriately licensed medical professionals pursuant to WELL ERA's medical oversight structure, Medical Director protocols, applicable professional standards, and Texas law.

Depending on the procedure, a client may be required to complete a medical evaluation, health screening, consultation, or clearance before treatment.

The Medical Director and other authorized medical professionals may establish or modify:

  • Treatment protocols
  • Clinical criteria
  • Contraindications
  • Safety standards
  • Treatment parameters
  • Delegation requirements
  • Medical clearance requirements
  • Emergency procedures
  • Documentation requirements
  • Other clinical policies

Medical and clinical judgment always takes priority over sales, promotional, scheduling, or administrative considerations.

No owner, manager, salesperson, esthetician, technician, employee, or other non-prescribing person may require a medical professional to authorize or perform a medical treatment that the medical professional determines is inappropriate, contraindicated, or unsafe.

3. Medical and Non-Medical Services

Not every service provided by WELL ERA constitutes medical treatment.

Certain facials, skincare services, cosmetic services, wellness services, and other aesthetic services may be non-medical in nature.

Other procedures may constitute medical services because of the device, treatment, medication, intended purpose, treatment depth, technology, or other characteristics involved.

When a service constitutes a medical procedure, WELL ERA will follow the medical evaluation, authorization, delegation, supervision, documentation, and professional requirements applicable to that procedure.

The commercial or marketing name used for a treatment does not determine whether a procedure is medical or non-medical.

4. Website Information Is Not Medical Advice

Information available through the WELL ERA website, advertisements, social media, educational materials, email, text messages, or other general communications is provided for educational and informational purposes.

Such information is not a substitute for an individualized medical evaluation, diagnosis, treatment recommendation, or advice from an appropriately licensed healthcare professional.

Nothing on the website should be interpreted as:

  • A medical diagnosis
  • A prescription
  • Medical clearance
  • A guarantee that a particular treatment is appropriate for you
  • A substitute for professional medical advice

Treatment eligibility can only be determined after appropriate consultation, screening, or medical evaluation when required.

  • New medical information
  • Contraindications
  • Client tolerance
  • Provider findings
  • Clinical judgment

Where required, material changes to medical treatment plans will be discussed with the client and handled in accordance with applicable informed-consent requirements.

6. Treatment Technologies and Brand References

WELL ERA may discuss or reference particular technologies, procedures, devices, brands, treatment categories, or competing treatments for educational, comparative, or explanatory purposes.

A reference to a particular device, technology, procedure, or brand during a consultation, advertisement, conversation, or educational discussion does not by itself mean that the referenced brand or device is included in a client's purchased treatment plan.

A specific branded treatment or device is considered part of a purchase only when it is expressly identified as such in the applicable written package description, purchase agreement, consent form, invoice, or other authorized WELL ERA documentation.

Customized programs may combine different treatment modalities according to the written treatment plan and clinical appropriateness.

7. Clinical Judgment and Treatment Eligibility

Purchasing a service, treatment plan, package, membership, promotion, or program does not override clinical judgment.

WELL ERA and its appropriately authorized providers may decline, modify, delay, postpone, discontinue, or recommend an alternative to a treatment when reasonably necessary because of:

  • A contraindication
  • Medical history
  • Medication use
  • Pregnancy
  • An implanted medical device
  • A recent procedure
  • Changes in health
  • Treatment response
  • Skin condition
  • Client safety
  • Provider judgment
  • Medical Director protocol
  • Applicable professional standards
  • Applicable law

Purchasing a package does not guarantee that a particular medical procedure will be performed if a qualified medical professional later determines that the procedure is not appropriate.

When appropriate, WELL ERA may recommend an alternative or modification consistent with the client's goals, applicable agreement, informed consent, and clinical requirements.

8. Client Medical Information and Responsibility

Clients are responsible for providing complete, current, and accurate information relevant to treatment.

This may include information regarding:

  • Medical conditions
  • Prescription and non-prescription medications
  • Allergies
  • Sensitivities
  • Pregnancy or possible pregnancy
  • Pacemakers
  • Electronic or implanted medical devices
  • Previous cosmetic procedures
  • Recent surgeries
  • Skin conditions
  • Previous treatment complications
  • Changes in health
  • Other information reasonably relevant to treatment safety

Clients must notify WELL ERA of material changes before subsequent treatments.

WELL ERA and its providers may reasonably rely upon information supplied by the client when evaluating treatment eligibility and safety.

Failure to disclose material information may affect treatment safety, results, eligibility, or the ability to provide a scheduled service.

9. Treatment Consent

These general Terms do not replace treatment-specific informed consent.

Certain treatments require separate consent forms, medical intake forms, medical evaluations, treatment instructions, acknowledgments, or other documentation.

A client may be required to complete applicable documents before treatment.

WELL ERA may decline to perform a treatment if required documentation, medical clearance, or informed consent has not been completed.

Treatment-specific risks and benefits are governed by the applicable informed-consent documentation and professional discussion.

10. No Guarantee of Results

Results from aesthetic, cosmetic, wellness, skincare, and medical aesthetic treatments vary among individuals.

WELL ERA does not guarantee any specific:

  • Degree of improvement
  • Percentage of improvement
  • Skin tightening
  • Lifting
  • Collagen response
  • Contouring result
  • Skin texture change
  • Pigmentation change
  • Weight or body change
  • Treatment duration
  • Number of sessions required
  • Timeline of results

unless an authorized written agreement expressly provides otherwise.

Individual results may depend upon numerous factors, including age, genetics, anatomy, health, skin condition, lifestyle, medications, hormones, treatment adherence, sun exposure, home care, smoking, previous procedures, biological response, and completion of recommended treatment sessions.

Some treatments require multiple sessions and maintenance.

11. Before-and-After Images and Testimonials

Before-and-after photographs, client testimonials, reviews, case studies, demonstrations, advertisements, social media content, and examples of previous results are provided for illustrative and educational purposes.

They do not guarantee that another individual will experience the same result.

Individual results vary.

12. Client Compliance and Aftercare

Clients are responsible for following reasonable preparation, treatment, and aftercare instructions provided by WELL ERA or an applicable healthcare professional.

Failure to follow treatment instructions may affect results or increase the likelihood of unwanted effects.

Clients should contact WELL ERA promptly if they experience an unexpected treatment reaction or have concerns following a procedure.

Serious or emergency medical symptoms should be evaluated through appropriate emergency medical services.

13. Appointments and Studio Policies

Appointments, reservations, cancellations, rescheduling, late arrivals, no-shows, deposits, promotional offers, vouchers, payment methods, product purchases, packages, client conduct, and other studio-related matters are governed by WELL ERA's Studio Policies & Booking & Cancellation Policy.

That policy is incorporated into these Terms by reference.

By booking or purchasing from WELL ERA, you acknowledge and agree to the Studio Policies applicable to your transaction.

Where a specific package, membership, financing, treatment, or purchase agreement contains different terms, the more specific agreement will govern that particular transaction to the extent permitted by applicable law.

14. Packages, Programs and Memberships

WELL ERA may offer customized treatment packages, programs, series, and memberships.

These offerings may be governed by separate written terms addressing matters such as:

  • Included services
  • Number of treatments
  • Treatment schedule
  • Treatment area
  • Payment obligations
  • Expiration
  • Cancellation
  • Transferability
  • Financing
  • Refunds
  • Other program-specific conditions

The applicable written package, program, or membership agreement controls those specific terms.

Unused services do not automatically create a right to a cash refund unless required by applicable law or provided in the applicable written agreement.

15. Pricing

Treatment prices may vary depending upon:

  • Technology
  • Appointment duration
  • Number of sessions
  • Customized treatment plan
  • Provider requirements
  • Promotions
  • Package structure

WELL ERA reserves the right to change pricing prospectively and to correct typographical, administrative, technical, or obvious pricing errors.

A pricing error on a website, advertisement, booking platform, or third-party listing does not require WELL ERA to honor an obviously incorrect price to the extent permitted by law.

Pricing applicable to an already completed purchase remains subject to the client's applicable agreement.

16. Promotions and Special Offers

Promotions, introductory offers, vouchers, special pricing, advertisements, and limited releases may have separate eligibility requirements and restrictions.

Promotional pricing does not automatically apply to other services, treatment areas, protocols, or future appointments.

WELL ERA may verify promotional eligibility and may reject duplicate, altered, fraudulent, improperly transferred, expired, or otherwise invalid promotional offers.

Specific promotional rules are further addressed in the Studio Policies & Booking & Cancellation Policy.

17. Payments

Payment obligations are governed by the applicable purchase agreement, package agreement, financing agreement, membership agreement, invoice, authorization, and Studio Policies.

By providing a payment method and authorizing a transaction, you authorize WELL ERA and its authorized payment processor to process charges you have approved or that are otherwise authorized under the applicable agreement.

Nothing in these Terms authorizes WELL ERA to make charges that are not permitted by the applicable authorization, agreement, or law.

18. Third-Party Financing

WELL ERA may make financing options available through independent third-party financing providers.

Financing approval, lending decisions, financing terms, interest rates, payment schedules, credit reporting, account servicing, and underwriting decisions are controlled by the applicable financing provider.

Clients are responsible for reviewing and accepting the financing provider's terms before entering into a financing agreement.

A financing relationship may create separate obligations between the client and the financing provider.

A treatment-related complaint or dispute does not automatically cancel an independent financing agreement or payment obligation.

19. Billing Disputes and Chargebacks

Clients who believe a billing error has occurred are encouraged to contact WELL ERA promptly so the matter can be reviewed.

If a client initiates a payment dispute, financing dispute, or chargeback, WELL ERA may provide relevant documentation to the applicable bank, payment processor, card issuer, financing provider, insurer, attorney, or other authorized party.

Documentation may include:

  • Transaction records
  • Booking records
  • Appointment history
  • Policy acknowledgments
  • Signed agreements
  • Electronic signatures
  • Communications
  • Treatment documentation
  • Invoices
  • Receipts
  • Medical or service records where legally permitted
  • Evidence that services were provided

WELL ERA may preserve relevant records while a dispute, complaint, investigation, or legal matter is pending.

20. Right to Refuse or Discontinue Service

To the extent permitted by law, WELL ERA may refuse, discontinue, delay, or restrict service when reasonably necessary to protect client safety, personnel, professional standards, or studio operations.

This may include situations involving:

  • Unsafe behavior
  • Harassment
  • Threats
  • Abusive conduct
  • Inappropriate behavior
  • Fraud
  • Intoxication or impairment
  • Repeated policy violations
  • Failure to disclose relevant medical information
  • Failure to follow required safety instructions
  • An unresolved payment or fraud concern
  • A medical contraindication

Nothing in these Terms obligates a professional to perform a service that the professional considers unsafe or inappropriate.

21. Privacy and Treatment Records

Personal information is handled according to WELL ERA's Privacy Policy and any additional medical privacy requirements applicable to particular information or providers.

Treatment documentation and medical information may also be governed by applicable healthcare privacy laws, professional requirements, consent forms, or separate privacy notices.

The Privacy Policy is incorporated into these Terms by reference.

22. Treatment Photographs

WELL ERA may create treatment photographs or other visual documentation for legitimate treatment purposes such as:

  • Treatment planning
  • Progress monitoring
  • Documentation
  • Safety
  • Professional consultation
  • Quality assurance

Internal treatment documentation is separate from public marketing authorization.

Identifiable client photographs, videos, testimonials, or likenesses will not be used for public advertising or promotional purposes when separate authorization is legally required unless the appropriate authorization has been obtained.

23. Intellectual Property

Unless otherwise stated, the WELL ERA website and its original content, branding, graphics, designs, photography, videos, written materials, treatment descriptions, educational materials, protocols, logos, trademarks, and other proprietary materials are owned by or licensed to WELL ERA.

You may access publicly available website content for ordinary personal and informational use.

Without written permission, you may not:

  • Reproduce substantial proprietary content
  • Republish proprietary materials
  • Commercially exploit WELL ERA content
  • Copy proprietary treatment or training protocols
  • Misrepresent WELL ERA content as your own

WELL ERA is not responsible for an independent third party's acts, omissions, service interruptions, underwriting decisions, privacy practices, or website content except to the extent responsibility cannot legally be excluded.

26. Electronic Communications and Signatures

You agree that WELL ERA may provide permitted agreements, acknowledgments, policies, receipts, appointment information, disclosures, and other communications electronically.

Where permitted by applicable law, electronic signatures, electronic acknowledgments, checked acceptance boxes, digital records, and electronically captured policy acceptance may have the same effect as corresponding paper records.

Clients are responsible for providing accurate contact information and keeping it reasonably current.

27. SMS and Text Messaging Terms

By separately opting in to receive SMS or text messages from WELL ERA INC., you consent to receive messages consistent with the consent you provided.

Messages may include:

  • Appointment confirmations
  • Appointment reminders
  • Scheduling communications
  • Customer service communications
  • Follow-up communications
  • Treatment or service information
  • Account-related communications
  • Promotional or marketing messages when separately authorized

Consent to receive promotional SMS messages is not a condition of purchasing products or services from WELL ERA.

Message frequency varies. Message and data rates may apply.

You may opt out of applicable text messages at any time by replying STOP.

After an opt-out request, WELL ERA may send one non-promotional confirmation message acknowledging the request.

This provision applies to website use and does not eliminate liability, healthcare obligations, professional duties, or consumer protections that cannot legally be limited or waived.

Treatment-specific risks and responsibilities are governed by applicable law, applicable professional standards, and the appropriate treatment-specific documentation.

32. No Creation of Medical Relationship Through Website Use

Merely visiting the WELL ERA website, viewing educational information, submitting a general inquiry, following WELL ERA on social media, or receiving general marketing information does not by itself establish a physician-patient or other healthcare-provider relationship.

A healthcare relationship may arise only through appropriate professional evaluation, acceptance, treatment, or other circumstances recognized by applicable law.

33. Governing Law

These Terms are governed by the laws of the State of Texas, except where federal law or another mandatory law applies.

For disputes arising specifically from these general website Terms and not governed by another agreement or mandatory legal provision, an appropriate state or federal court located in Dallas County, Texas may serve as the venue to the extent permitted by law.

Treatment agreements, financing agreements, membership agreements, or other specific contracts may contain separate dispute-resolution provisions.

34. Severability

If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be interpreted or limited to the minimum extent necessary where legally possible.

The remaining provisions will continue in effect.

35. No Waiver

WELL ERA's decision not to enforce a provision on one occasion does not constitute a permanent waiver of that provision or any other provision.

Any waiver applies only to the specific circumstance for which it was provided.

36. Changes to These Terms

WELL ERA may update these Terms to reflect changes in:

  • Business operations

  • Policies
  • Medical oversight requirements

The current version will be posted on the WELL ERA website with an updated "Last Updated" date.

Updates generally apply prospectively.

A previously signed treatment, package, membership, financing, or other specific agreement will remain governed by its applicable terms unless it is properly modified according to that agreement or applicable law.

37. Relationship With Other WELL ERA Agreements

These Terms form part of WELL ERA's general legal framework but do not replace specific agreements applicable to individual transactions or treatments.

WELL ERA may use additional documents including:

  • Privacy Policy
  • Medical intake forms
  • Treatment-specific informed consent forms
  • Package agreements
  • Membership agreements
  • Payment authorizations
  • Financing agreements
  • Photo and media authorizations
  • Aftercare instructions
  • Other treatment-specific documents

Where a specific signed agreement conflicts with these general Terms regarding the subject matter of that agreement, the specific agreement will control to the extent permitted by law.

38. Entire Website Terms

These Terms, together with WELL ERA's Privacy Policy and Studio Policies & Booking & Cancellation Policy, constitute the general terms governing use of the WELL ERA website and general interactions with WELL ERA.

They do not replace treatment-specific informed consent, medical documentation, package agreements, financing agreements, or other separately accepted agreements.
